DMCA / Copyright Policy

WKND respects intellectual property rights. Here is how to report copyright infringement on our platform.

Safe Harbor Statement

WKND Company is an online service provider as defined under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512. We qualify for safe harbor protection under DMCA Section 512(c) as a service provider that hosts user-generated content.

We do not monitor all content uploaded by users, but we respond promptly to valid copyright infringement notices and remove or disable access to infringing material.

Filing a DMCA Takedown Notice

If you believe that content on WKND infringes your copyright, you may submit a takedown notice to our designated DMCA agent. Your notice must include all of the following:

Identification of the copyrighted work

Describe the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.

Identification of the infringing material

Provide the URL(s) or sufficient detail to locate the allegedly infringing content on WKND.

Your contact information

Your full legal name, mailing address, phone number, and email address.

Good faith statement

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

Accuracy statement

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Your physical or electronic signature

A physical or electronic signature of the copyright owner or authorized representative.

We aim to respond to valid DMCA notices within 2 business days.

Counter-Notification Process

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:

  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, phone number, and email
  • A statement consenting to jurisdiction of the federal court in Wayne County, Michigan
  • Your physical or electronic signature

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed content.

Repeat Infringer Policy

WKND maintains a three-strike policy for copyright infringement:

Strike 1Content removed, account receives a warning
Strike 2Content removed, posting privileges may be temporarily suspended
Strike 3Account permanently terminated

Strikes may be removed if a successful counter-notification is filed. We reserve the right to terminate accounts at any time for egregious infringement, regardless of strike count.

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please ensure that your DMCA notice or counter-notification is accurate before submitting.
